Terms of Service
Terms governing access to the Cloud Process Base website and use of its local record-tracking and analytical software.
These Terms of Service (“Terms”) govern access to cloudprocessbase.click (the “Website”) and use of the Cloud Process Base application (the “Software”). By accessing the Website or using the Software, you agree to these Terms. If you do not agree, do not use them.
1. Description of the Software
Cloud Process Base is a local data tracking, organization, and analytical utility. It is intended to help users arrange compatible exported portfolio records, maintain historical information, and review summaries across account groups for informational and record-keeping purposes.
Cloud Process Base is solely a local data tracking utility and analytical software. It is not a financial institution, wallet provider, custodian, broker, exchange, or investment platform. The application does not hold, hold custody of, or process user funds or cryptocurrency assets, does not access private keys, does not execute transactions, and does not provide financial or investment advice. All information is provided for informational and record-keeping purposes only.
2. Eligibility and acceptance
You may use the Website and Software only if you can enter a binding agreement under the law applicable to you. If you use them on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
3. Permission to use
Subject to these Terms and any terms presented through the authorized store, you may use the Software for lawful personal or internal record-keeping purposes. You are responsible for obtaining records lawfully, maintaining source copies, checking the information you review, and securing your device and local files.
4. Prohibited use
You must not:
- use the Website or Software unlawfully or to infringe another person’s rights;
- attempt to disrupt, overload, bypass, probe, or compromise security or access controls;
- introduce malware or use the Software to distribute harmful material;
- misrepresent the Software as a financial institution, Binance product, official Binance service, or Microsoft product;
- use the Software to facilitate unauthorized access to accounts or information;
- remove or alter proprietary, attribution, or legal notices;
- reverse engineer or attempt to derive source code except where applicable law expressly permits it.
5. No financial service or advice
The Website and Software do not provide investment, financial, legal, accounting, or tax advice. Summaries and historical views are informational aids based on available records. They are not recommendations, trading signals, forecasts, guarantees, or substitutes for independent professional advice.
Cloud Process Base is not a financial institution, exchange, broker, trading platform, payment provider, or investment platform.
6. No wallet, custody, or transaction functionality
The Software does not provide a cryptocurrency wallet, request or access private keys, hold or take custody of assets, process funds, connect to wallets, or execute transactions. It cannot perform purchases, sales, transfers, deposits, or withdrawals.
7. User records and accuracy
You control which compatible records are made locally available to the Software. You are responsible for the legality, quality, completeness, and accuracy of those records. Imports and summaries may be affected by source formats, missing entries, inconsistent labels, or user choices.
Always compare important information with its authoritative source. Cloud Process Base does not certify records or produce official account, tax, or regulatory statements.
8. Intellectual property
The Website, Software, visual design, text, code, and associated materials are protected by applicable intellectual-property laws. Except for the limited permission stated in these Terms, no ownership right or license is granted by implication.
You retain rights you may have in records you lawfully make available to the Software. You are responsible for ensuring that your use of those records does not violate another party’s rights.
Binance® is a trademark of Binance Holdings Limited. Its name is used solely to indicate compatibility. Cloud Process Base is not a Binance product and is not affiliated with, endorsed by, sponsored by, or certified by Binance.
9. Third-party services
The Website links to the Microsoft Store homepage, and the Software may be obtained subject to store availability and separate third-party terms. Third-party services are operated independently. Cloud Process Base does not control and is not responsible for their content, availability, security, privacy practices, or terms.
A third-party link or compatibility reference does not imply ownership, endorsement, certification, sponsorship, or affiliation.
10. Software availability and changes
Features, compatibility, and availability may change over time. We may modify, suspend, or discontinue all or part of the Website or Software where reasonably necessary. We do not promise that a particular feature or third-party format will remain available.
You are responsible for preserving source records and backups. The Software should not be the only location where important records are kept.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Website and Software are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and compatibility.
We do not warrant that the Website or Software will be uninterrupted, error-free, completely secure, or compatible with every file, device, or future third-party format. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
12. Limitation of liability
To the maximum extent permitted by applicable law, Cloud Process Base will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, records, use, opportunity, profits, or goodwill arising from or related to the Website, Software, third-party services, or these Terms.
Where liability cannot lawfully be excluded, it will be limited to the minimum extent permitted by law. Nothing in these Terms excludes liability that applicable law does not allow to be excluded or limited.
13. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses, and reasonable costs arising from your unlawful use of the Website or Software, your violation of these Terms, or your infringement of another party’s rights.
14. Governing law and disputes
These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Courts with competent jurisdiction in Thailand will have jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere.
Before filing a claim, the parties should attempt in good faith to resolve the issue through the contact details below. This section does not limit rights or remedies that cannot be limited under applicable law.
15. Changes to these Terms
We may revise these Terms to reflect changes in the Software, Website, law, or operating practices. The effective date will be updated when revised Terms are published. Continued use after a revision takes effect constitutes acceptance where permitted by law.
16. General terms
If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without consent; we may transfer these Terms as part of a lawful organizational or asset transition.
